Last Will and Testament

Alexander Griffith 1740-1811

In the name of God Amen. I Alexander Griffith, farmer of Caroline County in the state of Maryland, being in reasonable good health, and of perfect sound disposing mind memory and understanding blessed by God, but calling to mind the mortality of my body, and knowing that it is appointed unto all men once to die, and being desirous to settle my worldly affairs, that I may be the better prepared to leave this world, when it shall please God to call me hence, do therefore make ordain publish pronounce and declare this to be my last will and testament in manner and forum following that is to say first and principally I give and recommend my soul into the hands of Almighty God who gave it, and my body to the earth to be buried in a decent and Christian manner at the discretion of my Executor, herein after named and after my just debts and funeral expenses are paid. I give, bequeath and devise and dispose of my property which it hath pleased the Lord to bless me with in this world as following:

Item: I give and bequeath unto my beloved wife, Mary Griffith, my gray horse Fox or any one of my horses which she may choose at my decease, and my new Chaise, also one cow and calf of her choice out of all I have, and also all that tract or parcel of land which I bought of William Potter Esq. that lays on the north side of the Mill branch, and where Abraham Evitty formerly lived with all and singular the improvements and appurtenances thereunto belonging or in any wise appertaining to have and to hold to her and her heirs or signings forever and also one years provision sufficient for her comfortable support and maintenance such as meat, corn and all other necessaries which shall need for one year after my decease as provision for food.

Item: I give and bequeath unto Henry Griffith and Thomas Griffith sons of my son Thomas Griffith deceased all that part of a tract of parcel of land called and known by the name of the "Worlds End", whereon my son Thomas formerly that did live with all and singular the improvements thereon to be equally divided between them to have and to hold to them and their heirs forever with this proviso never then less that Dorcas Griffith widow of Thomas Griffith and mother of the said Henry and Thomas shall have the said farm and all the privileges thereof for the support and maintenance of herself and her children until the boys shall achieve to lawful age to choose a guardian if they live so long and provided she does not marry until that time she making no willful waste or destruction thereon but should she marry then her right to cease.

Item: I give and bequeath unto my son Alexander Griffith all that tract or parcel of land whereon I now live called and known by the name of "Edmondson's Reserve" with all and singular the improvements thereon, to have and to hold to him and his lawful heirs forever, but should he die without assigns or heir lawfully begotten I then give the same to my son Abraham Griffith his heirs and assigns forever.

Item: I give and bequeath unto my son Abel Griffith part of a tract or parcel of land which I bought of Thomas Goldsborough called and known by the name of Goldsbourgh's Regulation, whereon he now lives binding with a line which I have run for a division line between him and my son Aaron Griffith (who is now deceased) then running with the out lines of said land agreeably to the plot thereof containing one hundred and ninety five and three quarters acres of land, with all and singular the improvements thereon to have and to hold to him during his natural life and from and after his decease I give and bequeath the same to his two sons John Griffith and Levi Griffith to be equally divided betwixt them to have and to hold to them their heirs and assigns forever.

Item: I give and bequeath unto Nancy Griffith widow of my son Aaron Griffith, all the remaining part of the said tract or parcel of land which I bought of the said Thomas Goldsborough whereon she now lives and which land I did intend for my son Aaron agreeable to the division made between him and my son Abel Griffith containing one hundred and ninety two acres and three quarters of an acre of land together with all and singular the improvements thereon or thereto belonging to have and hold occupy possess and enjoy for and during her widowhood or natural live if she lives single but not otherwise and from and after her decease or intermarriage I give and bequeath the same to Alexander Griffith and William Griffith sons of the said Aaron Griffith to be equally divided between them to have and to hold to them and their heirs forever on condition never the less that the said Alexander and William shall pay to their sister Betsey Griffith the sum of twenty five pounds like money as they shall severally arrive to the age of sixteen years.

Item: I give and bequeath unto my son Abraham Griffith all that tract or parcel of land which I bought of Peter Chilcutt and also a small piece I bought of William Lamper lying on the same side of the branch (as the branch is to be the division betwixt him and the heirs of my son Thomas) agreeable to their several names, metes, bounds, courses, and distances with all and singular the improvements and appurtenances thereto belonging to have and to hold to him his lawful heirs and assigns forever provided never the less that if my son Alexander Griffith die without lawful issue and my son Abraham fall heir to my home farm then and in such case I leave the land which have above written to hem to be sold and the money divided betwixt all my daughters equally.

Item: I give and bequeath to my daughter Sophia Lewis who married Aaron Lewis thirty dollars to be paid by my Executor out of my personal estate.

Item: I give to my daughter Sarah Hobbs wife of Joshua Hobbs three hundred dollars to be paid to her as aforesaid.

Item: I give to my daughter Mary Gowty wife of Pritchett Gowty one hundred dollars to be paid to her as aforesaid.

Item: I give to my daughter Nancy Todd wife of William Todd my negro woman Alce and all her children which negroes she had in her possession for some time before some of them run away and all though some of them is run away it is not my fault and if they do not get them again it is their own look out and also the sum of thirty dollars to be paid to her by my Executor out of my personal Estate

Item: I give to Eber Shearman son of Mary Shearman one hundred pounds for rent money to be paid to him by my Executor out of my personal estate, also one feather bed and furniture and one pine chest to be paid to him by my Executor when he arrives to the age of Twenty one years.

Item: I give to my beloved wife Mary Griffith all the property of every kind which she brought here when we was married and since which was her own before our marriage besides what I have given her in the just new of the will.

Item: I leave the remaining part of my personal estate to be equally divided among all my daughters to wit, Sophia Lewis, Sarah Hobbs,
Mary Gowty and Nancy Todd, share and share alike.
And lastly I leave my son Alexander Griffith whole and sole Executor of this my last will and testament well and truly to execute do and perform all things herein written according to the true intent and meaning of the same. Whereof, I the said Alexander Griffith have to this my last will and testament set my hand and affixed my seal this eleventh day of August, one thousand eight hundred and ten.

Signed, sealed, published, pronounced and declared by Alexander Griffith the within named testator, as and for his last will and testament in the presence of us who at his request in his presence, and in the presence of each other have subscribed our names as witnesses thereto.

There came Alexander Griffith as the Executor in and by the 5 March 1811 this will named and appointed and made oath on the Holy Evangel of Almighty God, that the a foregoing instrument of writing is the true and whole will and testament of Alexander Griffith late of Caroline County deceased that hath come to his hand, or possession, and that he doth not know of any other of a later date.

Then came Frederick Holbrook, Elijah Latterfield and Thomas Saulsburg the three subscribing witnesses to the a foregoing last will and testament of Alexander Griffith late of Caroline County deceased and severally made oath on the Holy Evangel of Almighty God, that they did see the testator herein named sign and seal this will, that they heard him publish, pronounce, and declare the same to be his last will and testament that at the time of his so soing he was to the best of their apprehensions of sound and disposing mind, memory and understanding that they respectively subscribed their names as witnesses to the will in the presence and at the request of the Testator and in the presence of each other.

In 1684 a 200 acre tract called "Griffiths Chance" was surveyed for Henry Griffith; it was located on the west side of Cone Creek (Nanticoke Creek). He later had several additional tracts patented.

Dorchester Land Record 5 OLD 140 dated September 1, 1699, shows that Henry Griffith married Elizabeth Tassell, the widow of Francis Tassell.

Dorchester Land Record 5 OLD 108 dated February 1, 1697/8 sows that Henry Griffith had a daugther, Elizabeth, who married Walter Cemey.

Henry Griffith, planter of Dorchester County, made a will dated February 22, 1708, which was probated August 9, 1709. In his will he named sons Samuel, John, and Abraham; daughter Sarah Griffith (Wills Part II - 12, 223).

Thomas Turner of Caroline County, Maryland

In the name of God amen I Thomas Turner of Caroline County being very on well in body but of sound an perfect memory thanks be to God for the same. I doe apoint an ordain this to be my last will an testament revoking all others lett them be of (?) tennor an date so ever,

Imprimus first ~ I give and bequeath my soul to almighty god my maker from whom I had it hoo seing through the meritts of our savior Jesus Christ our Redemour to obtain everlasting hapiness ab my body to be buried in decent an Christian manner an form.

Secondly ~ I give an bequeath unto my son Garrison Turner the plantation where Able Griffith now lives, the two tracts called or known by the names of "Banks of Pleasure" and "Rymold" an all that joins them to be equally divided between Thoms an Garrison an Thomas an Garrison to pay Henry an Enock an John an Jems one hundred pounds specie apiece which is four hundred pounds to the four boys, to the four boys as they come to the age of twenty one years old. If so be Thomas or Garrison dise without any heirs there for the youngest boy to take it an pay the other boys two hundred pounds. An to my son Thomas Turner one hors briddle an saddle an this to be the boys full share of my Estate, An my close to be divided between Thomas an Garrison an the rest of my estate to be equally divided amung my garls Lucrisha an Maryan an Saryan an An.

Lastly my will is that my dere an loven wife An Turner shall be whole and sole Executrix of my last will and testament, as witness my hand an seal this 25th day of June 1804.

Richard Willis of Caroline County. Maryland

Wife: Britania all that part of my land lying on the north west side of the County Road whereon my dwelling house stands, during her natural life or widowhood and after her decease to my youngest son Peter Willis to him and his heirs forever, it is also my will and desire that my daughter Ann Willis shall have a home in my dwelling house during her single life without being interrupted.

Item: I give and bequeath unto my son Senah Willis all that part of my land laying up the County Road and on the south east side of said Road down to a cross fence opposite the mouth of my lane and with that fence a straight line out to the line of said land to him and his heirs forever.

Item: I give and bequeath unto my son Foster Willis all the remaining part of said land lying on the south east side of said Road the cross fence before named to be the division line between them to him and his heirs forever.

Item: I give and bequeath unto my son Zachariah Willis all the lands which I purchased from Phillip Clark and Levin Stewart so far as it is lying joining together to him and his heirs forever.

Item: I give unto my two daughters Rebecah Corkren and Dorcas Willis the sum of fifty dollars each of them out of my moveable estate also fifty Dollars to my daughter Elisabeth Stevens to be paid as aforesaid.

Mentions 4 sons - Senah, Foster, Zachariah, and Peter again.

Then states - It is also my will and desire that there be no administration on my estate whatever.
